Dog Bites

San Diego, is a very dog friendly community.  Beaches in Del Mar, Coronado, Ocean Beach, community parks, restaurants and businesses alike welcome dogs onto their property, despite the potential risk of an attack or bite.  Owners have a duty to follow leash laws but often fail to do so.  Dog bites and attacks can cause horrific injuries.  Those injures include, puncture wounds, lacerations, cuts, scrapes, broken bones, infections, brain injuries, and permanent scarring (both physically and emotionally).  Being attacked by a large dog such as a pit-bull, Rottweiler, husky, Doberman Pincher, Chow, German shepherds, can be traumatic for the victim.

In a dog bite case, the owner of the dog is held strictly liable for any one dog bite and/or attack.  This is according to California Civil Code § 3342, which states:  “(a) The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner s knowledge of such viciousness.”

Injury victims of dog bites/attacks can be compensated for medical expenses, lost wages, hospitalization, rehabilitation, cost of surgeries, permanent injuries, pain and suffering, and emotional distress.  Usually in a dog bite case, the victim is able to receive compensation through the dog owner’s homeowner’s insurance.  However, the insurance companies can prove to be difficult and it is essential you retain a knowledgeable, aggressive personal injury attorney to maximize your recovery.  Contact The Law Office of Troy M.
